Welcome to the Spartanburg Area Mountain Bike Association (SAMBA). By accessing or using our website, becoming a member, participating in events, or using any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. Membership
SAMBA offers individual and family memberships. By registering for a membership, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and update your information to keep it accurate and current.
- Be responsible for maintaining the confidentiality of your account credentials.
- Accept responsibility for all activities that occur under your account.
Memberships are valid for the term specified at the time of purchase. SAMBA reserves the right to suspend or terminate memberships for violations of these terms or conduct that is harmful to the organization, its members, or the trails we maintain.
2. Assumption of Risk and Liability Waiver
Mountain biking and trail activities involve inherent risks, including but not limited to risk of serious injury or death. By participating in any SAMBA event, group ride, trail work day, or other activity, you acknowledge and voluntarily assume all risks associated with such participation.
To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless SAMBA, its officers, directors, volunteers, agents, and members from and against any and all claims, damages, losses, and expenses (including attorney fees) arising out of your participation in SAMBA activities or use of trails maintained by SAMBA.
Participants under the age of 18 must have a parent or legal guardian sign the waiver on their behalf.
3. Code of Conduct
All members and participants are expected to:
- Follow all posted trail rules, signage, and closures.
- Yield to other trail users as appropriate and ride within your abilities.
- Respect the environment by staying on designated trails and not littering.
- Treat fellow members, volunteers, and the public with courtesy and respect.
- Wear appropriate safety gear, including a helmet, during all riding activities.
- Report trail damage, hazards, or unsafe conditions to SAMBA.
SAMBA reserves the right to revoke membership or deny participation in events for violations of this code of conduct.
4. Trail Use
SAMBA builds and maintains trails in cooperation with land managers and property owners. Trail access is a privilege, not a right. Users must:
- Respect all trail closures, including weather-related closures (wet trails cause damage).
- Comply with all rules and regulations set by the land managers (e.g., South Carolina State Parks, City of Spartanburg).
- Not modify, build, or alter any trail features without authorization from SAMBA and the land manager.
5. Payments and Refunds
Membership dues and event fees are processed through PayPal or other payment processors as indicated. All payments are final unless otherwise stated. SAMBA does not offer refunds on membership dues. Event refund policies, if applicable, will be communicated on a per-event basis.
6. Intellectual Property
All content on the SAMBA website, including text, graphics, logos, images, and software, is the property of SAMBA or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without prior written permission from SAMBA.
7. Website Use
You agree not to:
- Use the website for any unlawful purpose or in violation of these terms.
- Attempt to gain unauthorized access to any part of the website, accounts, or systems.
- Interfere with or disrupt the website or servers connected to the website.
- Upload or transmit viruses, malware, or any other harmful code.
8. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices described in the Privacy Policy.
9. Volunteer Activities
SAMBA relies on volunteers for trail building, maintenance, and event support. By volunteering, you agree to follow all safety guidelines provided by SAMBA and the land manager. SAMBA provides certain tools and equipment for trail work, but volunteers participate at their own risk.
10. Limitation of Liability
To the maximum extent permitted by law, SAMBA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, services, or participation in SAMBA activities. SAMBA's total liability shall not exceed the amount of membership dues you have paid in the current membership year.
11. Modifications to Terms
SAMBA reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Spartanburg County, South Carolina.
